12/10/2008PUBLIC SAFETY REVIEW COMMITTEEJoel Plant indicated that there have been several staff meetings with City Managers including Police, Fire and other agencies to talk about the existing policies on property found. Plant indicated that the Mayor is supportive of the concept of the ordinance, but is opposed to the substance. Fiscally that it would be very expensive as an example; A City employee finds property, they would have to post a sign, and then in another 72 hours to review the property, and then another 72 hours to return the signs. The opinion of the Mayor and other City Managers said that the ordinance should apply to all found properties on City property, not just property of homeless individuals. Plant said that this ordinance should become an Administrative Procedure Manual (APM), which would become a policy for all City agencies. Plant indicated that not everything is completed on the recommendation and that he will be back to address the issue again. Pass

12/10/2008BOARD OF PARK COMMISSIONERSThe current process used by the Parks Division was distributed. It was noted that staff frequently finds personal property in our parks that may be discarded by individuals who just use our trash receptacles and the areas near them, or find items left behind after an event. It is difficult to determine whether an item belongs to a homeless individual or was intentionally discarded. Identifying all those probabilities will be challenging as well as determining where posting locations would be needed. In addition, staff required for the task of maintaining an inventory is not included in the budget nor does Parks have a location to store the items for 3 months. The proposed ordinance also requires that postings must be prepared in three languages. Parks Staff are working on identifying a protocol for implementation as well as the costs associated with them. Also, members of the Public Works Divisions are meeting to discuss the implications of this ordinance on their respective work forces. A motion was made by Wallner/Chewning/MacDonald to refer Ordinance ID#12176 Creating Section 8.32 of the Madison General Ordinances to create policies and procedures for removal of personal property from public lands for 90 days to the March 11, 2009 Park Commission meeting. MOTION CARRIED UNANIMOUSLY.

6/9/2009PUBLIC SAFETY REVIEW COMMITTEE(1) The ordinance on creating policies and procedures for the removal of personal property from public lands was returned to the PSRB because of a change in sponsorship in the City Council. PSRB was asked to re-review and vote for approval or non-approval. Tyrone Bell made a motion, for the purposes of discussion, to approve this ordinance and Professor Scott seconded this motion. Joel Plant from the Mayor’s Office explained the ordinance as it stands now and also indicated that he is working with the City Attorney’s Office on a draft charter ordinance. The new ordinance that would be established would create a uniform policy that would apply to all city agencies when property is found, and would not suffer from some of the logistical challenges that would be presented if the presently pending ordinance were adopted. There would also be a website established that citizens could search to see if their missing property is listed. Bell withdrew his motion to approve the ordinance, and Professor Scott, having seconded the original motion to approve, had no objection to Bell withdrawing his earlier motion to approve. Bell then moved to put this ordinance on file and Scott seconded the motion. The motion to place the ordinance on file was approved unanimously. A motion was made by Bell, seconded by Scott, to Return to Lead with the Recommendation to Place on File. The motion passed by voice vote/other.Pass
